Protecting Your Rights as a Consumer

The Consumer Protection Act, 2019, empowers consumers with rights against unfair trade practices, defective products, and deficient services. We provide expert legal assistance to ensure your rights are upheld and you get the justice you deserve.

Your Fundamental Rights as a Consumer

The law provides every consumer with six fundamental rights that form the basis of our practice:

  • Right to Safety: Protection from goods and services hazardous to life and property.
  • Right to be Informed: The right to know the quality, quantity, purity, price, and standard of goods.
  • Right to Choose: Access to a variety of goods and services at competitive prices.
  • Right to be Heard: The right to have consumer interests heard in appropriate forums.
  • Right to Seek Redressal: The right to get compensation for unfair trade practices or exploitation.
  • Right to Consumer Education: The right to acquire the knowledge and skill to be an informed consumer.

Grounds for Filing a Consumer Complaint

We can help you file a complaint and seek compensation in cases of:

  • Defective Goods: A product with a fault, imperfection, or shortcoming in quality or performance.
  • Deficiency in Service: Imperfection or inadequacy in the quality or manner of performance of a service. This includes medical negligence, insurance claim rejections, banking disputes, and delayed property possession.
  • Unfair or Restrictive Trade Practices: Misleading advertisements, fake discounts, or practices that obstruct the flow of capital or goods.
  • Overcharging: Selling goods or services at a price higher than the stipulated price (MRP).
  • Hazardous Goods: Offering goods for sale that are dangerous to life and safety without proper warnings.

The Three-Tier Redressal Mechanism

The law has established a simple and swift three-level system for resolving consumer disputes:

  • District Commission (DCDRC): For claims where the value of goods or services is up to ₹50 Lakhs.
  • State Commission (SCDRC): For claims valued between ₹50 Lakhs and ₹2 Crores. It also hears appeals against the orders of the District Commission.
  • National Commission (NCDRC): For claims valued above ₹2 Crores. It is the final appellate authority.

Our Fee Structure for Consumer Cases

Our fees for consumer cases are structured to be reasonable and transparent. The cost depends on the "weightage" of the matter, ensuring fairness for our clients.

Factors that influence the fees include: the value of the claim, the complexity of the issue (e.g., a defective product vs. a medical negligence case), the specific forum (District, State, or National), and the evidence involved. We will provide a clear fee estimate during our initial consultation.
